FOR WHAT PURPOSE DO WE COLLECT YOUR DATA and what are the legal grounds?

General information

Cooperation with us or using our portal may involve the need to provide us with your personal data. We keep the collected data strictly confidential, taking care of their security.

Personal data processed by Ima Design and IP Design Sp. z o. o. may be for the following purposes:

- presentations, offers, also on behalf of and for the benefit of entities cooperating with Ima Design and IP Design Sp. z o. o. - conclusion of a contract pursuant to art. 6 sec. 1 letter B of the GDPR Regulation

- consideration of complaints, appeals and appeals, pursuant to art. 6 sec. 1 lit. BC and lit. F GDPR Regulations

- marketing, including the promotion of Ima Design and IP Design Sp. z o. o.  or cooperating entities

- establishing and pursuing claims by Ima Design and IP Design Sp. z o. o. in connection with the conducted activity or defense against claims against Ima Design and IP Design Sp. z o. o

Data collected automatically

During your visit on our website www.imadesign.pl and www.ipdesign.com.pl some of your data will be collected automatically.

We collect and collect information such as: your IP address, request URL, domain name, device ID, browser type, browser language, number of clicks, amount of time spent on individual pages, date and time, operating system type and version, data collected in server logs and other similar information.

We have a profile of our studio on Facebook, which you can access from your individual Facebook account.  When leaving a comment or giving a review about our profile, you leave data, but remember that Ima Design does not have any permissions to your Facebook account, in particular to publish any content on it. We have an Instagram profile of our studio, which you can access from your individual account on  instagram.  When leaving a comment or giving a review about our profile, you leave data but remember that Ima Design does not have any rights to your Instagram account, in particular to publish any content on it. When you delete your Instagram account, we will not be   informed.

ON WHAT BASIS DO WE PROCESS YOUR DATA?

We process all data collected by us in accordance with the purpose for which they were collected and on the basis of applicable law. The basis entitling us to process your personal data may be:

  • contract between us

We will process your data when it is necessary to conclude a contract to which you are a party or when it is necessary to take action at your request before concluding a contract.

  • your consent

  • legal obligation

In certain specific situations, we need to process your data due to the need to fulfill our legal obligations.

These will be situations in which we need to store your data, e.g. data resulting from issued invoices for billing and tax reasons

  • legitimate interest pursued by us or by a cooperating entity

Your data will be processed by us when it is necessary for purposes resulting from legally justified interests pursued by us or by cooperating entities

However, we will not process your personal data in a situation where it turns out that overriding nature over our interests and the above-mentioned interests of cooperating entities will have your interests or your fundamental rights and freedoms.

For the above reasons, we inform you that based on our legitimate interest, we will process your data for the purpose of pursuing rights and defending against claims, for evidence and archival purposes.

On the same basis, we will also process your personal data collected automatically on our website to ensure session security and quality assurance

On the basis of our legitimate interest, we will also process your personal data for analytical purposes, which will consist in researching and analyzing traffic on our website, conducting market research and opinion research. We perform these tests on our own or outsource them to external research companies. The results of the research are aggregated and, as a rule, anonymised.

IS PROVISION OF DATA OBLIGATORY?

When concluding and performing a contract, we collect the data without which the contract cannot be performed. Failure to provide the data necessary for the conclusion and performance of the contract will result in the fact that we will not be able to conclude or perform it with you. This also applies to data that we must collect due to a legal obligation imposed on us (e.g. invoice data).

In a situation where we obtain your consent to the processing of personal data, it is completely voluntary. If you do not give the consent we ask for, then we will not take the action to which this consent relates.

You have the "right to be forgotten", so you can withdraw your consent at any time in a manner consistent with the way in which you previously expressed it. Remember, however, that withdrawal of consent does not affect the lawfulness of our processing of your personal data, which we made on the basis of consent before its withdrawal - this means that based on our legitimate interest, we will process your data for the purpose of pursuing rights and defending against claims for evidence and archival purposes.

WHO WILL WE SHARE YOUR PERSONAL DATA WITH?

In some situations, we transfer your personal data to cooperating entities. The recipients of your data are:

  • our authorized associates to whom your personal data will be disclosed so that they can perform their duties;

  • entities to which we commission the performance of services related to the processing of personal data (processors), these will be, for example, entities providing accounting services,  analityczne,  entities performing mailing campaigns, advertising agencies;

  • other recipients of data - e.g. our subcontractors, banks, tax advisors, law firms, notaries, courier companies, post office

  • other public bodies

  • Your personal data will not be transferred to a third country/international organization

 

DATA STORAGE PERIOD

The period of data storage is related to the purposes and basis of processing.

If, in connection with the performance of the contract concluded with us or in connection with the use of our portal, you purchase a service from us for an additional fee, then we will process your data for a period of 6 years due to the provisions of the tax law.

In other cases, we will store your data for a period of 6 years due to the limitation periods for claims.

In the remaining scope, except for data from cookie files, we will process your data until you withdraw your consent, express your objection or until you request data deletion.

After the indicated periods of time, your personal data will be deleted or anonymized.

YOUR RIGHTS

In connection with the processing of your data by us, you have a number of rights. You can use them, as well as for more clarification, by contacting us:

When contacting us, remember to provide us with your contact details and the preferred form and time of contact. Thanks to this, we will be able to answer your questions and expectations more efficiently. 

You are entitled to:

  • the right to request from us access to your personal data and the right to rectify it, delete it ("the right to be forgotten");

  • the right to object to the processing of personal data for direct marketing purposes, which causes us to stop processing your data for direct marketing purposes;

  • from May 25, 2018, the right to object on grounds related to your particular situation, if we process your personal data on the basis of a legitimate interest. However, we will continue to process personal data to the extent necessary if we have a legitimate reason to do so

  • from May 25, 2018, the right to transfer data processed in connection with the performance of the contract or on the basis of your consent and the right to limit data processing;

  • if the basis for the processing of personal data is your consent, you have the right to withdraw this consent at any time. Remember, however, that withdrawal of consent does not affect the lawfulness of our processing of your personal data, which we made on the basis of consent before its withdrawal - this means that based on our legitimate interest, we will process your data for the purpose of pursuing rights and defending against claims for evidence and archival purposes

If you believe that our processing of your personal data violates the law, you can lodge a complaint after May 25, 2018 with the supervisory authority that deals with the protection of personal data. In Poland, after May 25, 2018, it will be the President of the Office for Personal Data Protection.

WHAT DO WE USE COOKIES FOR?

Cookies are short information that our portal or our Partner saves on your computer's hard drive or in your mobile device in the form of text files, thanks to which we are able to analyze how popular a given offer on the portal or the portal itself is.

Remember that cookies are stored on your end device for the time specified in the cookie file parameters or until you delete them.
